Terms of Service

These Terms of Service apply to your use of coatpro.com.au and its subdomains, including our service landing pages, online estimate tools and online quote pages (the Website). The Website is operated by CoatPro Pty Ltd (ABN 21 681 094 057) (CoatPro, we, us). By using the Website you agree to these terms. If you do not agree, please do not use the Website.

1. About Us and How These Terms Fit Together

CoatPro provides concrete sealing, resurfacing, spraycrete, epoxy flooring and related services across South East Queensland. These terms cover your use of the Website. Any work we carry out is governed by the written Quote we issue and the terms and conditions attached to it (the Quote Terms). If anything in these terms is inconsistent with the Quote Terms, the Quote Terms prevail.

2. Who Can Use the Website

You must be at least 18 years old to request an estimate, book an inspection or accept a Quote. If you request work for a property, you confirm that you own the property or are authorised by the owner to arrange the work. If you act for a company, trust, body corporate or other organisation, you confirm that you have authority to bind it.

3. Acceptable Use

You may use the Website for lawful purposes only. You must not:

• use the Website in a way that breaches any law or regulation, or is fraudulent, misleading or deceptive
• give us false or misleading information, or pose as another person or business
• send unsolicited advertising, spam or malicious code through the Website or its forms
• attempt to gain unauthorised access to the Website, its servers or any connected system or database, or interfere with its operation or security
• use bots, scrapers, crawlers or other automated tools to access, copy or harvest content, pricing or data from the Website, including to train artificial intelligence models, without our written permission
• submit estimate or quote requests to obtain our pricing for a competitor or for any purpose other than genuinely considering our services

We may block access, reject submissions or cancel requests that we reasonably believe breach this clause.

4. Estimates, Calculators and Pricing

Estimates, price ranges and results from our online calculators, estimate wizard, articles or forms are general guides only. They are generated from the information you give us and from typical site conditions. They are not a Quote, an offer or a promise of price or outcome, and they do not create a contract.

• A contract is only formed when we issue a written Quote and you accept it in accordance with its terms.
• Final pricing depends on an assessment of the site, which may be carried out in person or from photos and measurements, and can differ from any online estimate.
• Prices are in Australian dollars and include GST unless stated otherwise.
• We may decline any request for an estimate, inspection or Quote.
• If a price shown on the Website or in an unaccepted Quote contains an obvious error, we may correct it before the Quote is accepted.
• Promotions, discounts and offers are subject to their stated conditions, apply to new bookings only unless stated, cannot be combined unless stated, and may be withdrawn at any time before a Quote is accepted.

5. Accepting a Quote Online

When you accept a Quote through our online quote page (for example by signing, typing your name or clicking to accept), you agree that your electronic acceptance is a valid signature and binds you to the Quote and the Quote Terms in the same way as a signed paper document, as permitted by the Electronic Transactions (Queensland) Act 2001. To keep an accurate record of the acceptance, we store the name you enter, your signature, the date and time, and technical details including your IP address, device and browser information. If you accept on behalf of a company, trust, body corporate or other organisation, the Quote Terms that apply to the person accepting, including any personal guarantee, apply to you.

6. Retention of Title

Title to and ownership of all coatings, sealers, epoxies and other products we supply and apply remains with CoatPro Pty Ltd until payment for the relevant project has been received in full in cleared funds. Until then, the applied product remains our property. If payment is not made in accordance with the agreed terms, we may enter the site and remove, grind off or otherwise recover the product, and you grant us, our employees and our agents a licence to enter the premises for this purpose. This right is in addition to any other rights and remedies available to us under the Quote Terms or at law, and the full detail is set out in the Quote Terms.

7. Service Disclaimers

We aim for an excellent result on every project. Please be aware that:

• Results depend on factors including the age, condition, porosity, moisture content and previous treatment of the concrete, weather during and after application, and how the surface is used and maintained.
• Colour samples, swatches, photos and videos on the Website are illustrative only. Actual colours, textures and finishes vary with the substrate, lighting, screen settings and natural variation in materials.
• Concrete is a natural material. Variations in colour and texture, efflorescence, hairline cracking, moisture or hydrostatic pressure from below, and existing stains can show through or affect a coating, and are not defects in our work.
• We are not responsible for pre-existing site conditions or defects, including inadequate or incorrect falls, drainage, ponding, cracking, spalling, delamination, structural movement or defects in the concrete or substrate before our work begins, or for defects that were hidden and could not reasonably have been detected before work started.
• Spraycrete, covercrete, sealers, epoxies and similar products are protective and decorative coatings only. They do not re-engineer, structurally repair, re-level or otherwise correct defects in the underlying concrete or substrate.
• Sealed and coated surfaces can be slippery when wet or contaminated. Slip resistance depends on the product, any additives, use, cleaning and maintenance.
• Coatings need time to cure. Using or loading a surface before the curing period we advise has ended can damage it.
• Warranty terms are set out in the Quote Terms and in the warranty documents issued on completion.

8. General Information and DIY Content

Articles, guides, cost ranges, videos and other content on the Website (including do-it-yourself guides) are general information only. They are not professional, engineering or site-specific advice and do not take your particular property or circumstances into account. If you carry out any work yourself, you do so at your own risk. Always follow the product manufacturer's instructions and safety data sheet, use appropriate protective equipment, and get professional advice for your situation. To the extent permitted by law, we are not liable for any loss, damage or injury arising from reliance on this content.

9. Content and Photos You Send Us

If you send us photos, videos, plans, descriptions, reviews or other material (through the Website, email, SMS, social media or otherwise), you confirm that you are entitled to share it and that it does not infringe anyone else's rights. You grant us a non-exclusive, royalty-free, perpetual licence to use that material to assess, quote for, plan and carry out work, and to keep records.

We may photograph and film our work before, during and after the project, and use those images and recordings, and any photos of our completed work that you share with us, on our website, social media, advertising and training material. We will not publish your name or street address with them without your consent. If you would prefer that images of your property are not used for marketing, email us at admin@coatpro.com.au and we will not use them for that purpose from then on.

Reviews and testimonials must be genuine and reflect your own experience. We may decline to publish, or remove, content that is unlawful, abusive, defamatory, fake or unrelated to our services.

10. Communications

When you submit a form, calculator or booking, or contact us by phone, email, SMS or social media, you agree that we may contact you by phone, SMS and email about your enquiry, estimate, Quote, booking or project. This includes automated reminders and follow-up messages about your Quote. We send marketing messages only in accordance with the Spam Act 2003, and you can opt out at any time by replying STOP to an SMS or using the unsubscribe link in an email. Calls with our team may be recorded or noted for quality, training and record-keeping purposes. Details are in our Privacy Policy.

11. Intellectual Property

All content on the Website, including text, images, graphics, logos, videos, icons, calculators and software, is owned by or licensed to CoatPro Pty Ltd and is protected by Australian and international law. The CoatPro name and logo are our trade marks. You may view and print pages for your personal use in considering our services. You must not otherwise copy, reproduce, distribute, modify or republish any material from the Website without our prior written consent.

12. Third-Party Links and Services

The Website may link to, or use, websites and services operated by others, such as booking calendars, maps, review platforms, payment providers and social media. We do not control them and are not responsible for their content, availability, privacy practices or terms, which apply when you use them. To the extent permitted by law, we are not liable for loss or damage caused by your use of third-party websites or services.

13. Availability and Security

We do not guarantee that the Website will always be available, uninterrupted, error-free or free of viruses or other harmful code. We may change, suspend or discontinue any part of the Website at any time. You are responsible for protecting your own devices and data.

14. Accuracy of Information

We make reasonable efforts to keep the Website accurate and up to date. However, content is provided in good faith as general information, may change without notice, and we do not warrant that it is accurate, complete or current.

15. Limitation of Liability

To the maximum extent permitted by law:

• the Website and its content are provided on an "as is" and "as available" basis, and all warranties, conditions and representations that are not expressly stated in these terms are excluded
• CoatPro Pty Ltd and its directors, employees, contractors and agents are not liable for any indirect or consequential loss, or for any loss of profit, revenue, data, opportunity or goodwill, arising out of or in connection with the Website or its content
• our total liability to you arising out of or in connection with your use of the Website (as distinct from work carried out under a Quote, which is governed by the Quote Terms) is limited to $100

16. Indemnity

You indemnify CoatPro Pty Ltd and its directors, employees, contractors and agents against any claim, loss, liability, cost or expense (including reasonable legal costs) arising from your breach of these terms, your unlawful use of the Website, or any material you send us that infringes another person's rights, except to the extent the loss was caused by our own negligence or breach.

17. Privacy

We handle personal information in accordance with our Privacy Policy, which explains what we collect, how we use and share it, and how to access or correct it.

18. Cookies and Tracking

The Website uses cookies, pixels and similar technologies to operate the Website, analyse traffic, record how visitors use pages, and measure and improve our advertising. These include:

• Google Analytics, Google Tag Manager and Google Ads
• the Meta (Facebook and Instagram) Pixel and Meta Conversions API
• Microsoft Clarity, which records clicks, scrolling and page interactions
• Ahrefs Web Analytics

19. Changes to These Terms

We may update these terms from time to time by posting a new version on this page with a new "last updated" date. The updated terms apply to your use of the Website from the date they are posted. Changes do not affect a Quote you have already accepted, which remains governed by the Quote Terms that applied when you accepted it.

20. General

• Governing law: These terms are governed by the laws of Queensland, Australia. You and we submit to the exclusive jurisdiction of the courts and tribunals of Queensland and the courts that can hear appeals from them.
• Severability: If any part of these terms is invalid or unenforceable, it will be read down to the extent necessary, or severed, and the rest of these terms continue in full force.
• No waiver: If we do not enforce a right under these terms, or delay doing so, we have not waived that right.
• Events outside our control: We are not liable for any failure or delay in providing the Website caused by events beyond our reasonable control.
• Assignment: We may assign or transfer our rights under these terms, including in connection with a sale or restructure of our business.
